It is legal as long as there's a control operator present at all times while the beacon is running. And of course all other amateur rules apply, such as power limits, etc.

He's also got a 10 meter beacon, so that may have been why I was confused. If he's running one on 30 meters, there has to be a control operator present while it's running.

Beacons operating from 28.200 to 28.300 MHz can be automatically operated. I've been running a beacon on 28.233 for a number of years now.
